NorixMedia operates an e-commerce platform that sells home gardening products directly to consumers across Ireland and the European Union. Our product range includes, but is not limited to, herb starter kits, vegetable grow boxes, kitchen garden sets, balcony bloom collections, family growing bundles, individual seedlings, organic peat-free compost, biodegradable pots and planters, plant food, and printed care guides.

All seedlings are sourced from Irish nurseries located in Co. Meath and Co. Wexford and are selected for their suitability to the Irish climate and growing conditions. Our kits are designed for beginners and require no prior gardening knowledge. Each product listing on the Website includes a description, pricing in euros (EUR), contents list, and estimated delivery timeframe.

In addition to product sales, we provide free informational content on our Website, including growing guides, seasonal planting calendars, and frequently asked questions. This content is provided for general informational purposes and does not constitute professional horticultural advice. Results from using our products may vary depending on local conditions, care provided, and environmental factors.

All prices displayed on the Website are in euros (EUR) and include Value Added Tax (VAT) at the applicable Irish rate unless otherwise stated. Delivery charges, where applicable, are displayed before you complete your order and are added to the total price at checkout.

Placing an order through the Website constitutes an offer to purchase the selected products. We reserve the right to accept or decline any order at our sole discretion. An order is only confirmed when we send you an order confirmation email. Until that confirmation is sent, no binding contract of sale exists between you and NorixMedia.

We make every effort to ensure that prices and product descriptions on the Website are accurate. However, errors may occasionally occur. If we discover a pricing error after you have placed an order, we will contact you as soon as possible to inform you and give you the option to proceed at the correct price or cancel the order for a full refund.

Promotional codes cannot be combined with other offers unless explicitly stated, and they may have an expiry date, a minimum order value, or be limited to specific products.

5 Delivery

We ship from our distribution centre in Ashbourne, Co. Meath, Ireland. Standard delivery within Ireland takes 3 to 5 business days. Express next-day delivery is available for an additional fee of €6.99 to most urban areas in Ireland, including Dublin, Cork, Limerick, Galway, and Waterford. Orders over €50 qualify for free standard delivery within Ireland.

For deliveries to other EU member states, standard delivery takes 5 to 10 business days depending on the destination. International shipping charges are calculated at checkout based on your delivery address and the weight of the order.

Delivery times are estimates only and are not guaranteed. We are not liable for any delays caused by circumstances beyond our reasonable control, including but not limited to weather events, postal service disruptions, customs processing, public holidays, or carrier issues. If your order has not arrived within the estimated delivery window, please contact us at [email protected] and we will investigate.

Because our products include live seedlings, we package all orders carefully with protective insulation and moisture-retaining materials. If your plants arrive damaged due to transit conditions, please contact us within 48 hours of delivery with photographs, and we will arrange a replacement or refund at no additional cost.

6 Returns and Refunds

Under the European Union (Consumer Rights) Directive as transposed into Irish law by the European Union (Consumer Information, Cancellation and Other Rights) Regulations 2013 (S.I. No. 484/2013), you have the right to cancel your order within 14 days of receiving the goods, without giving any reason. To exercise this right, you must inform us by email at [email protected] or by post to our registered address.

Due to the perishable nature of live seedlings and plants, the 14-day cancellation right does not apply to orders containing live plant materials once they have been delivered. This exemption is in accordance with Regulation 13(1)(d) of S.I. No. 484/2013, which excludes goods that are liable to deteriorate or expire rapidly.

For non-perishable items such as planters, tools, compost, and accessories, you may return them within 14 days of receipt provided they are unused, in their original packaging, and in a resalable condition. Return shipping costs are your responsibility unless the item was defective or incorrectly delivered.

Our 21-day sprouting guarantee applies to all seedlings and seed products. If your plants do not show growth within 21 days of setup and you have followed the provided care instructions, we will send you a replacement kit free of charge. To claim under this guarantee, email us at [email protected] with your order number and a photograph of the non-sprouting plants.

Refunds for eligible returns will be processed within 14 days of receiving the returned goods. Refunds are issued to the original payment method used for the purchase.

7 Intellectual Property

All content on the NorixMedia Website, including but not limited to text, graphics, images, photographs, logos, product descriptions, care guides, seasonal calendars, page layouts, software code, and the overall design and arrangement of the Website, is the exclusive property of NorixMedia Ltd or its content suppliers and is protected by Irish and international copyright, trademark, and other intellectual property laws.

The NorixMedia name, logo, and all related product names, service names, design marks, and slogans are trademarks of NorixMedia Ltd. You may not use, reproduce, or display any of these trademarks without our prior written consent.

You are granted a limited, non-exclusive, non-transferable, revocable licence to access and use the Website and its content for personal, non-commercial purposes only. This licence does not include the right to collect, aggregate, copy, duplicate, display, or create derivative works from the Website content. Any unauthorised use of the Website content may violate copyright, trademark, privacy, and other laws and may result in legal action.

8 Disclaimers

The Website and all products and services offered through it are provided on an "as is" and "as available" basis. NorixMedia does not guarantee specific growing results from any of our products. Plant growth depends on numerous factors outside our control, including but not limited to light exposure, watering frequency, temperature, soil conditions, pest activity, and individual care practices. The growing tips, seasonal calendars, and care instructions provided on our Website are general guidance and may not account for every local variation in climate or conditions.

Any claims regarding potential savings on grocery costs are based on estimates derived from average market prices for common herbs and vegetables in Irish supermarkets during the 2025 growing season. Your actual savings may be higher or lower depending on your purchasing habits, the varieties you grow, and how successfully your plants produce.

To the fullest extent permitted by applicable Irish and EU law, NorixMedia disclaims all warranties, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Nothing in these Terms shall exclude or limit any rights you have under mandatory consumer protection legislation in Ireland or the EU.

9 Limitation of Liability

To the maximum extent permitted by Irish and EU law, NorixMedia, its directors, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of or inability to use the Website, your purchase or use of any products, or these Terms. This includes, without limitation, loss of profits, loss of data, loss of goodwill, business interruption, or any other intangible losses.

In the event that NorixMedia is found liable for any direct damages, our total aggregate liability to you for all claims arising from or related to the Website or any products purchased shall not exceed the amount you paid to NorixMedia for the specific order that gave rise to the claim, or one hundred euros (€100), whichever is greater.

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, for defective products under the Liability for Defective Products Act 1991, or for any other matter for which liability cannot lawfully be excluded or limited under Irish or EU law.

10 Indemnification

14 Dispute Resolution

15 Termination

NorixMedia reserves the right to suspend or terminate your access to the Website, in whole or in part, at any time and for any reason, including but not limited to: violation of these Terms, suspected fraudulent or illegal activity, misuse of promotional offers, or behaviour that we reasonably believe may cause harm to NorixMedia, our customers, or third parties.

Upon termination, your right to use the Website ceases immediately.
